1. Data controller
The controller of your personal data is BeLuxe Estate, Test, tax ID (NIP): Test, registered under Test ("we"). Contact: info@beluxestate.com, Test. We have not appointed a Data Protection Officer.
2. What we process, why and on what basis
- Enquiry handling and offers: name, e-mail address, phone number, chosen destination and the history of our contact, to answer your enquiry and take steps at your request before a contract (Art. 6(1)(b) GDPR).
- Contact by phone and e-mail: on the basis of your consent (Art. 6(1)(a) GDPR and Art. 398 of the Polish Electronic Communications Law).
- New-offer e-mails: only if you ticked the optional box, on the basis of your consent. Every message has an unsubscribe link. We record when you open an offer through its personal link, but we do not use tracking pixels.
- Assigning your enquiry to an advisor: the advisor's link or the campaign that brought you to us, and the fact that you opened an offer we sent you, on the basis of our legitimate interest in organising sales and settling cooperation with advisors (Art. 6(1)(f) GDPR).
- Security: protecting the form against bots and abuse, including a short-lived hash of your IP address, on the basis of our legitimate interest (Art. 6(1)(f) GDPR).
- Claims: establishing, pursuing or defending claims (Art. 6(1)(f) GDPR).
3. Is providing data mandatory?
It is voluntary, but without your name, e-mail address and phone number we cannot answer your enquiry.
4. Recipients
Your data is available to our team and to the advisor handling your enquiry. We also use providers acting on our behalf: Cloudflare, Inc. (hosting, database, form protection with Turnstile) and Resend (sending e-mails). If it is needed to carry out your request, we pass the necessary data to a developer, seller or lawyer involved in the transaction.
5. Transfers outside the EEA
Our providers may process data in the USA and other countries, on the basis of the EU-US Data Privacy Framework or standard contractual clauses. You can obtain a copy of these safeguards from us. Because we sell property in Thailand, which the European Commission has not recognised as ensuring an adequate level of protection, we pass data to partners there only when you ask us to pursue a specific property or with your explicit consent (Art. 49(1)(a) and (b) GDPR).
6. Retention
We keep enquiry data for up to 3 years from our last contact and data of clients who bought a property for up to 6 years, after which it is deleted automatically. If you withdraw consent or object, we stop contacting you at once and keep only what we need to demonstrate compliance or handle claims.
7. Your rights
You have the right to access your data, rectify it, erase it, restrict processing, port it and object to processing based on legitimate interest. You may withdraw consent at any time, without affecting the lawfulness of earlier processing, by writing to info@beluxestate.com. You may also lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
8. Automated decisions
We do not make automated decisions with legal or similarly significant effects, and we do not profile you for such purposes.
9. Cookies
